1. Agreement to Terms
These Terms and Conditions (“Terms”) govern your use of the Boost Health Rx website (the “Site”) and all services provided by Boost Health Rx, LLC (“we,” “us,” “our”). 2. Eligibility
Our services are available exclusively to individuals who are 18 years of age or older. By using our Site or services, you represent that you meet this age requirement. We do not offer any services to minors under any circumstances.
3. Services and Use
Boost Health Rx, LLC provides elective wellness and medical services exclusively through a virtual telehealth model. All consultations, evaluations, prescriptions, and follow-ups are conducted remotely through secure electronic communication. We do not operate as a primary care provider, and we do not provide any in-person care. If you are experiencing a medical emergency, you agree to call 911 or go to the nearest emergency department immediately.
4. Account Registration
To access services, you may be required to create an account and provide accurate, up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
5. Patient-Provider Relationship
By using our services, you may establish a direct patient-provider relationship with a licensed healthcare provider affiliated with Boost Health Rx, LLC. These providers are responsible for your care and medical decisions. Boost Health Rx serves as the administrative and technology platform supporting their delivery of care.
6. Payments and Billing
All services are self-pay. We do not accept or bill insurance, and you agree to pay for all services rendered using a valid payment method. Payment is due at the time of booking or service. Refunds are not issued after services are provided. You authorize us to charge your card or payment method for services and any applicable fees for cancellations, missed appointments, or unpaid balances.
7. Prescription Fulfillment
If your provider prescribes a medication, the prescription may be transmitted to a pharmacy that works with Boost Health Rx. You authorize us to share necessary health and billing information with such pharmacies for the purpose of fulfilling your prescription.
8. Privacy and HIPAA
Your use of our services is subject to our Privacy Policy and all applicable healthcare privacy laws, including the Health Insurance Portability and Accountability Act (HIPAA). We are committed to protecting your personal and health information and will use it only as described in our Privacy Policy.
9. Intellectual Property
All content on our Site, including text, images, graphics, software, and logos, is the property of Boost Health Rx, LLC or its licensors. You may not copy, reproduce, modify, or distribute any content without our express written permission.
10. User Conduct
You agree not to misuse the Site or services, including by submitting false or misleading information, attempting to access services for anyone under 18, interfering with system operations, or violating any laws or third-party rights. We reserve the right to suspend or terminate your access for any violation of these Terms.
11. Disclaimers and Limitations of Liability
We provide all services “as is” and “as available” without warranties of any kind. We make no guarantees about clinical outcomes, availability, or accuracy of content. 12. Indemnification
You agree to indemnify, defend, and hold harmless Boost Health Rx, LLC, its affiliates, owners, staff, and contracted providers from any claims, losses, damages, liabilities, or legal fees resulting from your use of the services, violation of these Terms, or breach of any applicable law.
13. Termination
We may suspend or terminate your account or access to the Site or services at our discretion, including for suspected fraud, misuse, or violations of these Terms. You may also terminate your use of services at any time, but any financial obligations will remain enforceable.
14. Changes to Terms
We may update these Terms at any time. Updates will be posted with a new effective date, and continued use of the services after that date constitutes your acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the state in which Boost Health Rx, LLC is headquartered, without regard to conflict of laws principles. Any legal disputes shall be resolved in courts located within that jurisdiction, unless arbitration is mutually agreed upon in writing.
